PLEASE READ THESE BOOKING TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS SITE AND/OR PROCEEDING WITH ANY BOOKING. THIS IS A BINDING LEGAL AGREEMENT. BY ACCESSING AND CONTINUING TO USE THE SITE OR PLACING A BOOKING, YOU AGREE TO EACH AND EVERY ONE OF THESE TERMS AND CONDITIONS.

 

  1. Introduction

These Booking Conditions, together with our privacy policy and any other written information, apply to your booking with either Denizen Italy Real Estate SRL, with registered office at Via Vincenzo Gioberti 8, 20123 – Milano, Italy, for bookings in our building in Florence, Italy, or Denizen Hospitality Morocco SARL A.U., with registered office at 93/97 Kàat Bennahid, Tichnbest, Marrakech Medina, Morocco, for booking in our building in Marrakech, Morocco.  Our brand name is “This Time Tomorrow”.

 

  1. Definitions

“Us”, “we”, “our” refers to our companies Denizen Italy Real Estate SRL and Denizen Hospitality Morocco SARL A.U, respectively

“Building” means the property that you selected as accommodation, located at Viale Don Giovanni Minzoni 3, 50129 FIRENZE FL, Italy, for bookings in Florence or located at 93/97 Kàat Bennahid, Tichnbest, Marrakech Medina, Morocco, for bookings in Marrakech

“Residences” refers to apartments in one of our buildings that a guest rents subject to the terms in this agreement

“Services” refers to a booking, a stay, or use of our website

“Guests” or “you” refers to individuals making a reservation, staying, or using services provided by us

“Website” refers to our official website, www.thistimetomorrow.io

“Agreement” refers to these Terms and Conditions.

 

  1. Website Usage

3.1 Information

You will access our services through our website. The content on our website is provided in good faith and is routinely refreshed; however, we cannot ensure its absolute completeness and accuracy. We disclaim any liability to you or any third party for any inaccuracies or omissions on our website. We reserve the right to modify, update, or remove any information on the site without prior notice, and it is your responsibility to verify the website’s information and adhere to these terms and conditions each time you make a booking.

3.2 Availability

All products and services shown on our website are subject to availability. Our website contains information on our products and services, not all of which are available at all times.

3.3 Accuracy

We have endeavored to depict our products and services as accurately as we can on our website. The photographs and videos showcased are for illustrative purposes, and actual details may differ based on the chosen product or service category. If there’s a minor inconsistency between the product or service description and the accompanying visuals on the website, the description takes precedence. For any specific needs not addressed on the website, please reach out to us using the contact information provided below for verification.

 

  1. Reservations and Bookings

4.1 Booking Process

You will be required to provide the name, email and telephone number of at least one lead Guest. You will have the opportunity to verify and correct any information relating to your booking at each stage, before confirming the booking. To complete your booking, you will be required to accept this Agreement. If you do not accept this Agreement, you must not place your booking. All bookings are strictly subject to acceptance of this Agreement.

4.2 Reservation Confirmation

Your reservation is not confirmed until you receive a confirmation. Reservation confirmations will be sent via email and include specifics on the type of residence booked, dates, and total cost. It is your responsibility to contact us if a confirmation email has not been received. You should also review the confirmation email promptly and notify us of any inaccuracies within 24 hours. We are not liable if we are not notified of any inaccuracy in the documentation of the reservation as soon as possible. If there is an error in the confirmation or invoice, we reserve the right to correct it as soon as we become aware of it.

4.3 Booking

Any booking made will only come into existence when payment has been made in full or once a payment card has been validated for refundable rates. Upon completing your booking and receiving your confirmation email, you enter into a binding contract with us based on these terms and conditions for your stay.

4.4 Check-In

Upon check-in, guests may be required to show the credit/debit card used to pay for the booking and a valid photo ID, such as a passport or driver’s license, in order to verify your booking. We will also collect your photo ID details to comply with local regulations to report guest stays in our buildings to the appropriate authorities.

4.4 Group Bookings

We offer bookings of entire floors, the entire building, or bookings for extended stays in a single residence for a month or longer. These group bookings have different cancellation terms and payment terms.

 

  1. Payments

5.1 Prices

The prices for a booking will be provided on our website. All prices are subject to change and the price provided shall only be valid for bookings made at the time the price is provided. Once a booking has been confirmed, the rate which has been quoted will not be changed unless you amend or modify the booking. VAT and any other applicable taxes are charged at the rate in force at the time of the booking.

5.2 Non-refundable bookings

Non-refundable bookings are offered at a reduced rate to compensate for a ‘no-cancellation’ and ‘no-amendment’ policies. No refund will be made in the event of cancellation of a non-refundable booking and you will be charged the full amount of the booking. Payment in full is required at the time of booking.

5.3 Refundable bookings

Refundable bookings are offered with the option to cancel a booking up to the time of the non-refundable time-period, which is 14 days from the check-in time on the day of arrival. Payment in full is required at the time of the expiration of the time of the non-refundable period.

5.4 Group bookings

Group bookings will be handled by us manually in communication with you over the phone, video, or by email. We will send you a confirmation and once you accept the arrangement, the price shall be paid as follows: 30% of the total price shall be paid upon confirmation, 40% of the price shall be paid at least three months prior to the arrival date and the balance of 30% of the price shall be paid within one month from the arrival date. In case a group booking is made within two months of arrival, then 100% payment of the total price must be made in at the time of reservation. We are entitled to cancel the reservation and retain the deposited amount if the balance of the total price is not paid within the relevant due dates as described above.

5.5 Security Deposit

A payment of a EUR 500 for Florence and EUR 250 for Marrakech refundable security deposit will be charged (pre-authorized) upon arrival during check-in and held in a non-interest-bearing account. The security deposit will be returned to the guest in full at check-out, provided there are no damages, missing items, no additional cleaning for the residences left abnormally dirty and no other outstanding charges are due. If the above conditions are not met, we will deduct the required amount from the security deposit. If this deduction is less than the security deposit that has been paid, the resulting balance will be refunded upon check-out. Judgment as to the amount to be charged is left to our sole discretion. Guests are obliged to pay additional charges should any damage exceed the amount of the security deposit.

 

  1. Additional Fees

You will be liable for any breakages, damage, extra cleaning charges, late checkout, any extras ordered during your stay and/or any additional charges incurred by us as a result of your stay.

6.1 Extra services

We can accommodate guest requests for the following extra services, all subject to availability and subject to additional VAT charges:

  • Extra person with extra bed in a residence (EUR 100 per night)
  • Baby cot (free of charge) – only available in our Florence building
  • Pets (EUR 50 per night) – only available in our Florence building
  • Late check-out (EUR 100 for every additional two hours) – a stay after 12am will require a full booking for the next day

6.2 Missing Items

We make items of our bathroom toiletry lines, towels and bathrobes and selected kitchen items available for sale. If we notice missing inventory upon the check-out process, we will bring these items to your attention and any replacements costs will be determined by us and may be deducted directly from the security deposit.

6.3 Damages, Excessive Cleaning

Guests are responsible for any damages that occur during their stay, including but not limited to damage to furniture and artwork, cleaning necessitated by smoking in the residences, and excessive cleaning requirements of the residence. The costs for repairs or replacements will be assessed at our discretion and may be deducted from the security deposit. We kindly request that bathroom towels and bathrobes not be removed from the property for use outside (e.g., for the beach).

 

  1. Cancellations and Modifications

7.1 Refundable bookings

If you wish to modify any detail of your confirmed refundable booking, we will try to make the change, which may result in an increase in rate depending on the date and length of stay. However, we cannot guarantee that we can accommodate any changes requested. All changes of date, location and length of stay are subject to availability and rate change at the then applicable rates. All requests for changes must be made to us in writing. Should any change be rejected, the original booking will be re-instated. If you which to cancel a refundable booking, before the non-refundable period has begun, you can do this via our website and no price will be charged to you. In case that the non-refundable period has already started on a refundable booking (i.e., fewer than 14 days from the booking time of arrival), no cancellations or modifications of the booking can be made.

7.2 Non-refundable bookings

There are no refunds for cancellations of non-refundable bookings. There are no modifications for non-refundable bookings.

7.3 Our Changes

In rare instances bookings have to be changed or cancelled or booking details corrected and we reserve the right to do so. If this does happen, we will contact you immediately by phone or email. If a change has to be made or your booking has to be cancelled, we will, if possible, offer you an alternative accommodation of similar type and standard in a similar location for the same period. If the alternative accommodation is advertised at a lower price, you will receive a refund of the price difference. However, if the alternative accommodation is at a higher price the new price will be payable. If you do not wish to accept a change or any alternative residence offered or we cannot offer you a suitable alternative accommodation, you may be entitled to cancel your booking and receive a refund. You should tell us as soon as possible whether you wish to accept any change or alternative accommodation offered or alternatively if you want a refund. We will have no liability for any costs, damages or losses that you incur as a result of any changes or cancellations to your booking and your sole remedy will be a refund of the charges paid to us.

 

  1. Building and Residence Usage

All residences are intended solely for temporary or holiday accommodation purposes for you. They should not serve as your primary or additional home, and guests are not entitled to a tenancy, assured short-term tenancy, or assured tenancy. No landlord-tenant relationship is established, and there is no statutory security of tenure, neither presently nor upon the end of the occupancy period. Failure to vacate the premises at the end of the agreed period will result in appropriate accommodation charges for the extended occupation period. Only guests have the right to utilize the residences, with the maximum number of guests determined by the available beds. Exceeding this maximum may result in refusal of access or additional charges for extra residences, at our discretion.

 

  1. House Rules

9.1 Check-in and Check-out

Our check-in time is 15:00 local time and our check-out time is 11:00 local time in Florence and 12:00 local time in Marrakech. Late check-out and early check-in are available at our sole discretion. Requests must be made in advance and are subject to availability and additional charges may apply.

In the case of a no show, residences will be held until 01.00am on the day after the scheduled arrival, at which time your booking will be cancelled and we will charge you 100% of the residence rate.

9.2 Age restrictions

We welcome all ages in our Florence building, but have a minimum age requirement of 14 years in our Marrakech building. Guests must supervise any babies and children at all times when using the terrace and balcony areas. The lead guest for all bookings needs to be 18 years old or older.

9.3 Visitors

Guests are allowed a maximum of two over-night visitors during their stay. Guests are responsible for ensuring that the maximum numbers of beds are not exceeded for their respective residence and that visitors obey these terms and conditions. Any additional overnight visitors must be approved in advance by us and are subject to an additional fee as noted in Section 6.1. for extra beds. Day-time visitors are allowed until 01:00 in the building. Larger gatherings must comply with respect for other guests regarding an acceptable noise level and need to be approved us in advance.

9.4 Smoking

As a commitment to providing a healthy and comfortable environment for all our guests and staff, we have implemented a strict non-smoking indoor policy throughout our buildings. Smoking, including the use of electronic cigarettes and vaping devices, is prohibited in all indoor areas, including guest residences, corridors, lobbies, and other public spaces. We enforce this policy without exceptions and guests who violate this policy may be subject to additional cleaning fees and penalties. You are welcome to smoke on all balconies, terraces, and other outdoor spaces.

9.5 Pets

In our Florence building, we welcome pets that have been previously approved in a written authorization. Such authorization may be revoked if the pet constitutes a danger for the property or other persons. The authorized pets are the sole responsibility of the guest, and we shall not be deemed liable for any damage, injury or death caused by the pet/pets or to the pet/pets, even if authorized. Pets should be kept on a leash at all times during their stay in our building. Eventual damages that pets might cause will be charged to the guest and taken out of the security deposit. No pets are allowed in our Marrakech building.

9.6 Kitchens

In our Florence building, every residence is equipped with a kitchen and our Marrakech building has a communal kitchen. The use of the Kitchen equipment is at the guest’s own risk.

9.7 Garbage and Recycling

We are committed to environmental sustainability and responsible waste management and provide separate recycling bins for paper & carton, glass & plastic and general waste. Excess rubbish must not be left in public or common areas.

9.8 Windows

Windows are locked due safety reasons and to ensure the proper functioning of the air conditioning system. In case that you would like to open the windows, please ask the property manager to sign a waiver form that you are aware that any loss or theft resulting from the windows being left open is the responsibility of the guest. It’s essential to note that we do not hold any liability for any inconvenience, discomfort, or loss of property resulting from the decision to open windows.

9.9 Emergencies

Our buildings are equipped with fire alarm systems, fire extinguishers, and clearly marked exit routes. Guests should not use the elevator in case of fire or an emergency but use the staircases.

 

  1. Guest Conduct and Responsibilities

10.1 Respect for Others

Guests are expected to treat fellow guests and staff with courtesy and respect. Guests and visitors must keep noise to a minimum as not to disturb other guests and the occupants of neighboring properties – especially during night-time hours (23:00 – 7:00), and upon arrival and departure. Excessive noise is prohibited at all times and may result in the termination of this agreement, eviction, loss of charges paid, and extra charges which may be deducted from the security deposit.

10.2 Prohibited Activities

Any engagement in illegal activities within the residences and building will result in immediate eviction and reporting to local authorities. It is strictly prohibited to bring or use any drugs into our property, and we cannot be held responsible at any time for any damages or death due to drug use. You are also not allowed to bring firearms into the property.

10.3 Cleanliness

As part of our commitment to maintaining high standards of cleanliness and ensuring a luxurious stay for all guests, we reserve the right to impose additional cleaning charges for residences left in an excessively dirty condition upon check-out. Excessive dirtiness is defined as any state beyond the normal wear and tear expected during a guest’s stay. This includes but is not limited to:

  • Stains on carpets, furniture, or bedding that require specialized cleaning or replacement.
  • Accumulation of trash, food, or debris throughout the residence.
  • Spillage of substances such as beverages, food, or cosmetics that require extensive cleaning.
  • Excessive dirt, mud, or sand tracked into the room from outdoor activities.
  • Damage caused by pets, including shedding, accidents, or scratching furniture.

10.4 Leaving the Building

Guests should make sure that when leaving the residences, that they close and properly lock all windows, balcony doors, and terrace doors of a residences and that all valuable items are locked in the safe. Guest should make sure that when leaving the building, that the main building door is properly closed. It is for the safety of all guests.

10.5 Parking and Driving

Florence has a Restricted Traffic Limitation (ZTL) and no one is allowed to drive into the historic city center with a vehicle. We cannot be held responsible for any traffic fines. Parking is available close by our Florence building at an additional fee. In Marrakech, we will arrange transportation to our building directly from the airport.

10.6 Health Issues

Guests with disabilities or health concerns are encouraged to contact us prior to making a reservation to ensure that our facilities meet their needs and are suitable for their use. Additionally, guests are requested to inform us in advance of any allergies they may have.

We are committed to providing a comfortable and safe environment for all our guests. While we strive to eliminate potential allergens in our residences, such as perfume and food, we cannot guarantee an entirely allergen-free environment. Guests with severe allergies are advised to take necessary precautions and bring any required medications or protective measures.

It is important to note that while we take reasonable measures to accommodate our guests’ health concerns, we cannot accept liability for any health issues that may arise during their stay. Guests are responsible for managing their own health conditions and should take appropriate precautions as needed.

 

  1. Liability

In adherence to our commitment to transparency and guest understanding, our liability policy is designed to outline the parameters of our responsibility while safeguarding our guests’ interests. While we strive to provide an unparalleled luxury experience, it is imperative to clarify that we operate with limited liability for certain unforeseen events. We value the safety and satisfaction of our guests and remain dedicated to providing a secure and enjoyable environment, and our liability policy serves as a mutual understanding of the boundaries within which our responsibilities operate.

11.1 Liability for Personal Property

We assume no responsibility for the loss or damage of personal property, including valuables, jewelry, and cash, whether stored in rooms or common areas. We encourage guests to utilize the safe deposit boxes provided in each room for the protection of their valuable items. Guests utilize them at their own risk.

11.2 Liability for Services

We are committed to providing high-quality services but cannot be held liable for any disruptions or inconveniences caused by events beyond our control, including but not limited to natural disasters, acts of terrorism, public disturbances, or government regulations. Guests are encouraged to obtain appropriate travel insurance to cover any unforeseen circumstances during their stay. Our liability is also limited in cases where services may be affected due to maintenance, renovations, or circumstances that necessitate temporary closures.

11.3 Compensation

While we strive to address issues promptly, any compensation for such disruptions is at our discretion. However, no compensation will be provided for services affected by circumstances beyond our control.

11.4 Our Liability

To the extent permitted by law, neither we nor any of our officers, directors, employees, representatives or agents shall be liable to you or any guest (whether in contract, tort or otherwise) for any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation and our liability to you shall be limited to the total charges paid by you in relation to the booking in relation to which the relevant liability arose.

 

  1. Governing Laws

12.1 Florence

For bookings in our Florence building, these Terms and Conditions are governed by the laws of Florence, Italy. Any disputes shall be exclusively resolved in the courts of Florence, Italy.

By agreeing to these terms and conditions, guests declares that they have read and accepted the general conditions of the contract which form an integral part of the booking form and which have been the object of careful individual negotiation and declares that it approves the purposes and effects of articles 1341 and 1342 of the Italian civil code, as well as articles 33 et seq. of the Legislative Decree no. 206/2005 (Italian consumer code).

12.2 Marrakech

For bookings in our Marrakech building, these Terms and Conditions are governed by the laws of Marrakech, Morocco. Any disputes shall be exclusively resolved in the courts of Marrakech, Morocco.

 

  1. Changes to Terms and Conditions

We reserve the right to update these Terms and Conditions with changes becoming effective upon posting on our website. Guests are advised to check for updates regularly.

 

  1. Feedback and Contact Information

In the unlikely event that you are dissatisfied with any aspect of your accommodation please notify the property manager as soon as possible. If you do not give us the opportunity to resolve a problem during your stay, it is impossible to help rectify any issues with your stay.
